Arizona Client made the serious mistake of drinking and driving. Client was lawfully stopped and provided field sobriety tests (HGN, one leg stand, and the walk and turn test). She failed those tests and was arrested. Client was charged with four DUI charges, including super extreme DUI.
However, the police failed to properly read her the admin per se rights, pursuant to A.R.S. 28-1385. The police body camera captured the Client chewing gum just minutes before the breath test. The Defense filed a motion to dismiss. The State offered a very lenient plea, in light of the charges, to a reckless driving.
